Terms of Service

Draft · not yet in force Updated

A draft, not yet in force. These terms are being finalised before Quern launches; no lawyer has reviewed them yet. Facts not known yet are shown as placeholders, and a bracket that says “to be” marks something not decided or not built yet.

Who we are

These terms cover Quern (“the app”) and are between you and <<COMPANY_LEGAL_NAME>>, whose registered office is <<REGISTERED_OFFICE>> (“we” or “us”). We run the app.

1. Who can use the app

You must be 18 or older. By creating an account or continuing as a guest, you confirm that you are. If we learn an account belongs to someone under 18, we delete it.

2. Your notes are yours

You own what you save, write and record in the app, and the notes made from it. You give us only the permission we need to run the app for you: to store your notes, sync them to your phones, and process them (including with our AI providers, as the Privacy Policy explains) to make and improve your notes. We don’t sell your notes or show them to anyone else. We never send what you write, record or upload to a company that may train AI on it; the Privacy Policy names the one service that may get a claim from a public page you saved.

3. Notes made from other people’s work

When you save someone else’s video, post or page, the note the app makes from it is for your own private use – for your study, research, or reference – as Indian copyright law allows (Copyright Act, 1957, s.52). The app keeps the source’s name and link with every such note, so the work stays credited. Don’t republish notes made from other people’s work as your own, or use the app to copy and redistribute it. The app doesn’t download or let you save other people’s media.

4. AI can be wrong

Some notes, answers, summaries, translations and fact-checks are written by AI, and they’re labelled. AI can be wrong, incomplete or out of date. Check anything important against the source, and don’t rely on the app for medical, legal, financial or safety decisions. If an AI note is offensive or harmful, tell us at <<PRIVACY_CONTACT_EMAIL>>.

[Report this AI note, from the note’s More menu: to be added when it’s built.]

5. Acceptable use

Don’t save, store or share anything in the app that:

  • belongs to someone else, when you have no right to it (a note made for your own private use, as section 3 explains, is fine);
  • is obscene or pornographic, invades someone’s privacy, or harasses or threatens anyone;
  • harms a child in any way, including anything that sexually exploits a child;
  • infringes a patent, trademark or copyright;
  • you know is false, and is meant to deceive or mislead;
  • impersonates someone;
  • threatens India’s unity, security or public order, or promotes terrorism or violence;
  • carries a virus or any other harmful code;
  • breaks any law.

And don’t:

  • get around a site’s or platform’s access controls, logins or paywalls (the app never uses your logins to fetch anything, and you shouldn’t make it try);
  • attack, overload, reverse-engineer for abuse, or probe the service, or use it to send spam;
  • use someone else’s account.

We may suspend or end an account that does these things, after telling you why unless the law or safety prevents it.

6. The free allowance and a paid plan

The app is free to use, with a monthly allowance of AI notes; past it, a note keeps its quick note and its AI note waits for the next month.

[A paid plan’s terms – price in ₹ including GST, what it adds, renewal, and cancelling as easily as subscribing, from Settings, through Google Play – will be added here before any price is offered.]

7. Ending

You can stop at any time: delete your account from Settings → Account, or on the web at <<DELETION_URL>> (it’s kept 30 days in case you change your mind, then deleted). Export your notes first if you want them. We may stop offering the app; if we do, we’ll give you at least 30 days’ notice and time to export.

8. Our responsibility

We work hard to keep your notes safe and the app running, but the app is provided as it is. To the extent the law allows, we aren’t liable for indirect or consequential losses, or for decisions made on AI output; and our total liability to you is limited to the amount you paid us in the 12 months before the claim (nothing, on the free plan). Nothing here limits rights you have that the law doesn’t let us limit.

9. Changes

If these terms change in a way that matters, the app tells you before the change applies. Continuing after that means you accept the new terms; if you don’t, you can delete your account. A change in how we use your personal data follows the Privacy Policy: a new purpose is asked for first.

10. The law, and complaints

These terms are governed by the laws of India. Write to <<PRIVACY_CONTACT_EMAIL>> first, our privacy and grievance contact. We confirm we’ve got your message within 24 hours and settle it within 15 days; a request to remove content is dealt with within 72 hours.

[Courts with jurisdiction: to be named.]
